1. Welcome & Acceptance of Terms

Welcome to Diners Den. These Terms & Conditions govern the access, usage, interaction, browsing, ordering, payment, communication, participation, and overall engagement with the Diners Den platform, including but not limited to its website, QR-based menu systems, restaurant interfaces, ordering systems, mobile services, communication channels, digital promotions, payment integrations, loyalty systems, customer engagement mechanisms, and related services.

By accessing, browsing, interacting with, registering on, or otherwise using Diners Den in any manner whatsoever, users acknowledge that they have read, understood, and agreed to be legally bound by these Terms & Conditions. Users who do not agree with any portion of these Terms are advised to discontinue the use of the platform and associated services immediately.

2. Platform Operations & Third Parties

Diners Den operates primarily as a technology-enabled platform intended to facilitate restaurant discovery, menu browsing, customer engagement, digital ordering, payment processing assistance, promotional visibility, restaurant communication, and related interactions between users and independent restaurant partners. Diners Den itself does not independently own, operate, manufacture, prepare, package, deliver, or directly supervise the restaurant products and services listed through the platform unless explicitly stated otherwise.

Users acknowledge that restaurants, delivery providers, payment systems, communication systems, and associated operational partners available through the platform function as independent third-party entities and may maintain their own operational standards, pricing policies, refund practices, delivery systems, promotional structures, customer support processes, and internal policies.

The availability of any restaurant, menu item, offer, promotion, discount, dining benefit, pricing structure, loyalty program, estimated delivery time, reservation facility, or payment method displayed through Diners Den shall not be interpreted as a binding commitment, warranty, guarantee, endorsement, certification, or assurance by Diners Den regarding the quality, availability, authenticity, legality, consistency, reliability, or continued existence of such products or services.

3. User Conduct & Misuse

Users are expected to provide accurate, current, and complete information while using the platform. Diners Den reserves the right to suspend, restrict, terminate, investigate, or refuse access to any user account, order, transaction, communication, activity, or engagement that appears misleading, fraudulent, abusive, suspicious, unlawful, manipulative, technically harmful, commercially exploitative, or otherwise inconsistent with the intended operation of the platform.

Users agree not to misuse the platform in any manner, including but not limited to unauthorized access attempts, automated scraping, fraudulent transactions, fake order placement, payment manipulation, promotional abuse, impersonation, system interference, reverse engineering, unlawful data extraction, or activities that may negatively impact platform operations, restaurant partners, delivery systems, payment systems, or other users.

Diners Den reserves the right to monitor platform usage, investigate suspicious activity, cooperate with law enforcement authorities, preserve transactional records, restrict platform functionality, or take appropriate legal or operational action where necessary for security, compliance, fraud prevention, operational continuity, or business protection purposes.

4. Orders & Restaurant Duties

All orders placed through Diners Den remain subject to restaurant acceptance, operational availability, serviceability, stock availability, payment confirmation, technical verification, and applicable restaurant policies. Diners Den does not independently guarantee order confirmation, uninterrupted service availability, successful delivery, food quality, preparation standards, ingredient accuracy, packaging standards, or operational conduct of restaurant partners.

Users acknowledge that menu information, food descriptions, ingredients, images, pricing details, taxes, discounts, offers, estimated delivery timelines, preparation times, and promotional campaigns may occasionally contain technical inaccuracies, temporary discrepancies, outdated information, pricing errors, unavailable items, or unintended display issues caused by restaurant updates, external systems, network delays, operational changes, or technological limitations.

Restaurants retain independent authority to modify, revise, suspend, reject, discontinue, cancel, deny, limit, or alter any offer, menu item, pricing structure, service condition, discount campaign, reservation facility, or operational commitment at their discretion and subject to their internal policies. Diners Den shall not be responsible or liable for situations where restaurants refuse discounts, deny promotional benefits, cancel orders, change pricing after publication, alter operational policies, discontinue services, reject reservations, delay deliveries, modify menu availability, or otherwise fail to meet customer expectations.

Any dispute relating to food quality, hygiene standards, restaurant conduct, allergic reactions, delayed deliveries, pricing disputes, denied offers, order cancellations, customer service dissatisfaction, ingredient concerns, packaging issues, refund disagreements, dine-in experiences, restaurant-level operational failures, or service-related dissatisfaction shall primarily remain between the user and the respective restaurant partner.

5. Payments, Fraud & Refunds

Payments facilitated through Diners Den may involve integrations with independent payment gateways, banking systems, UPI systems, wallets, processors, financial institutions, or external payment service providers. Diners Den does not independently control the operations, processing timelines, approval mechanisms, settlement systems, technical functioning, security standards, banking infrastructure, or dispute management systems of such financial intermediaries.

Users acknowledge that all payment-related actions should be undertaken with independent caution and responsibility. Diners Den shall not be liable for payment failures, settlement delays, fraudulent transactions, unauthorized banking activity, technical banking disruptions, payment gateway outages, duplicate debits, chargeback disputes, UPI failures, card processing failures, telecom interruptions, phishing activities, fake payment requests, unauthorized QR codes, scam calls, fake representatives, unofficial payment links, or payments made outside officially verified Diners Den systems.

Users are strongly advised to verify payment authenticity before authorizing any transaction and to avoid making payments through unofficial communication channels, third-party intermediaries, unauthorized representatives, social media messages, or external payment links not officially recognized by Diners Den.

Refunds, cancellations, reversals, promotional adjustments, wallet credits, or compensation requests may remain subject to restaurant policies, payment provider timelines, operational review, fraud checks, transaction verification, and applicable business rules. Diners Den reserves the right to decline, suspend, delay, investigate, or reverse any transaction, refund, incentive, promotional benefit, or account activity that appears suspicious, technically inconsistent, abusive, unlawful, commercially manipulative, or potentially fraudulent.

6. System Reliability & Downtime

The Diners Den platform may occasionally experience interruptions, outages, maintenance periods, network failures, technical errors, infrastructure issues, latency problems, cyber incidents, external service disruptions, data synchronization failures, software bugs, communication delays, or operational downtime. Diners Den does not guarantee uninterrupted access, permanent data availability, continuous uptime, error-free operation, or flawless technical performance.

Users understand and acknowledge that internet-based services inherently involve certain technological limitations and operational risks. To the maximum extent permitted under applicable law, Diners Den shall not be liable for losses arising from technical disruptions, delayed communication, inaccessible services, infrastructure failures, software errors, third-party outages, corrupted data, server downtime, cybersecurity incidents, device failures, malware attacks, or unauthorized access attempts.

7. Intellectual Property & Brand

All content, branding, designs, trademarks, logos, technology systems, interfaces, graphics, workflows, software components, layouts, operational concepts, communication structures, and intellectual property associated with Diners Den remain the exclusive property of Diners Den or its respective licensors unless otherwise specified. Unauthorized copying, commercial exploitation, reproduction, distribution, extraction, resale, reverse engineering, duplication, republication, or misuse of any platform component is strictly prohibited.

Diners Den reserves the right to modify, suspend, discontinue, restrict, redesign, replace, monetize, commercialize, optimize, or otherwise alter any feature, functionality, business model, pricing structure, restaurant visibility mechanism, communication system, promotional activity, subscription service, loyalty structure, or operational process without prior notice.

8. External Services & Integrations

The platform may include integrations, links, communications, advertisements, services, APIs, software systems, promotional campaigns, or operational support provided by independent third parties. Diners Den does not independently endorse, supervise, verify, or guarantee the accuracy, legality, quality, reliability, operational standards, security practices, or business conduct of such external entities.

Users interacting with third-party services, advertisements, payment systems, restaurant systems, communication channels, delivery providers, external websites, or promotional partners do so entirely at their own discretion and risk.

9. Liability & Indemnification

To the fullest extent permitted under applicable law, Diners Den, its founders, employees, affiliates, technology providers, licensors, partners, contractors, representatives, and associated entities shall not be liable for any indirect, incidental, consequential, punitive, reputational, commercial, financial, technical, emotional, operational, or business-related losses arising directly or indirectly from platform usage, restaurant interactions, technical failures, promotional disputes, payment issues, cyber incidents, unauthorized access, third-party misconduct, delayed services, denied discounts, inaccurate listings, order failures, infrastructure disruptions, or inability to use the platform.

Users agree to indemnify, defend, and hold harmless Diners Den and its associated entities from and against any claims, liabilities, losses, disputes, damages, investigations, legal proceedings, penalties, costs, or expenses arising from user misconduct, misuse of the platform, violation of these Terms, fraudulent activities, unlawful conduct, payment disputes, restaurant-level conflicts, or any activity connected with the user’s interaction with the platform.

10. Governing Law & Kolkata Jurisdiction

Diners Den reserves the right to revise, update, amend, modify, replace, or discontinue these Terms & Conditions at any time without prior notice. Continued use of the platform after such modifications shall constitute acceptance of the revised Terms.

These Terms & Conditions shall be governed and interpreted in accordance with the laws of India. Any disputes arising in connection with the platform or these Terms shall remain subject to the jurisdiction of competent courts located in Kolkata, West Bengal.

Users are advised to interact only through officially verified Diners Den communication channels and to independently exercise caution while engaging in transactions, communications, or promotional interactions involving the platform.
